FAQs about Custody and Parenting Time During the COVID-19 Outbreak

Parenting Time and Child Support Issues EO 2020-35

Please Note:  The Federal legislation passed regarding the stimulus payments has required States to intercept those monies.  The State and local Friend of the Court offices are not able to override the Federal statute.  We understand how very difficult this information is, but we have no local control to change the situation.  We are working with families to the best of our ability during this state of emergency and request that you continue to keep your co-parent and your case manager updated with whether or not you are receiving any income or are able to make some or all of your child support payment at this time.  Again, we are working with families during these very difficult times and only ask that you do your best to stay well and to keep your family and our office informed of any changes.

In cases wherein the children receive cash assistance or there is an active foster care case, $150 in past-due support (over and above the current month’s obligation) must be owed for the offset requirement to apply. For circumstances with only Medicaid provided for the children and no other public assistance, $500 of past-due support (over and above the current month’s obligation) must be owed for the offset requirement to apply. The economic impact payment offsets will adhere to the same fees, distribution timeframes, and hold periods as federal tax refund offsets.
